B. Introduction

The programme is for the advancement of research and analytical skill in the context of Islamic ethics and values. The knowledge so acquired should substantially enhance their prospects of gaining employment in various capacities such as academics, professional and other areas of work where the ability to apply and advise upon Islamic legal issues is significant.

C. Philosophy

The philosophy of the programme is for the enhancement of research and professional skillin Islamic Laws and ability to function effectively and comprehensively in academics locallyand globally.

D. Aim and Objectives

The aim of the programme is to stimulate excellent research and working skills based on stronger foundation and better understanding of the role of Islamic law in a contemporary context. The objectives include:

  1. producing graduates of distinction committed to lifelong learning and professionalism capable of being responsible leaders and communicators in their respective fields;
  2. critically engage with the major theoretical debates on the role of Islamic law in any given field;
  3. displaying the ability to deal with different types of legal system and laws; applying critical and contextual approaches across a wide variety of subject matters; and
  4. developing the ability to analyse. Articulate and write legal issues, by linking previous and current experiences with academic inquiry, particularly via dissertation.

E. Admission Requirements

The candidates are required to possess the following:

  1. ‗O‘ Level Credits or its equivalent in five subjects including English Language, Mathematics and Islamic Religious Study or Arabic Language.
  2. A first degree in Islamic Law or Common and Islamic Law or equivalent from a recognised university with at least a Second Class Lower ( Division) Honours,
  3. Candidate with Master degree Islamic Law from a recognised university must have scored at least 60% or its equivalent in their final Master degree Examination to qualify for admission for Doctor of Philosophy in Islamic Law programme. Such prospective candidates must have a working knowledge of Arabic language and are required to satisfy the faculty postgraduate Board at a placement screening exercise.

F. Duration of the Programme

The Full-time programme shall run for a minimum of 36 calendar months and a maximum of 48 calendar months . The Programme is full time study only.

G. Detailed Course Description

ISL 901 Legal Research Methodology 2 Credits

Principles Methods and approaches to legal research and writing. Selection of research topics. Research design in legal study. Research methodology and research Methods. Finding materials in the library. Stages of Legal research. Using social research methods. Referencing. Formatting. Ethical Issues in Legal research. Tips Tips on Dissertation/project. ISL 999 Thesis 10 Credits

Each student under the guidance of an approved supervisor is required to conduct research in any area of interest approved by the faculty postgraduate board. 450h (P); C

Note:

In addition, candidates who have not taken the following LL.M. Courses – ISL 801,802, 803 and 804 or their equivalent at LL.M level must take them as additional pre-requisites for graduation.

H. Graduation Requirements

For the award of Ph.D. in Islamic Law, a candidate must have passed the prescribed courses and submitted a thesis based on preceding research protocol. The provision of the Postgraduate school shall apply in the assessment of the research protocol and oral examination of the thesis.
